Terms of Service

These Terms of Service ("Terms") govern your access to and use of the VisaFlow website and related services (collectively, the "Service") operated by VisaFlow ("we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of the Service

VisaFlow provides general information, organizational tools, checklists, processing-time estimates sourced from public IRCC data, document-tracking features, and optional expert messaging related to Canadian immigration pathways (study permits, work permits, and permanent residence).

VisaFlow does not provide legal advice, immigration advice, or representation before Immigration, Refugees and Citizenship Canada (IRCC) or any tribunal. We are not a law firm, licensed immigration consultant (RCIC), or paralegal firm unless explicitly stated otherwise in a separate written agreement. You are solely responsible for your immigration decisions and applications.

2. Eligibility and accounts

  • You must be at least 16 years old to use the Service.
  • You agree to provide accurate registration information and to keep your credentials confidential.
  • You are responsible for all activity under your account. Notify us promptly if you suspect unauthorized access.
  • We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or abuse risk.

3. Plans and payments

Free and paid plans may be offered. Pricing, features, and billing cycles are described on our Plans page. When payment processing is enabled, additional payment terms will apply at checkout. Unless required by law, fees are non-refundable once a billing period has started, except as stated in a specific refund policy.

We may change plan features or pricing with reasonable notice. Continued use after a change constitutes acceptance of the new terms for your plan.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of IRCC rules.
  • Upload malicious code, scrape or overload our systems, or attempt unauthorized access.
  • Misrepresent your identity, impersonate others, or submit false immigration information through consultant messaging.
  • Copy, resell, or redistribute Service content except as permitted by us in writing.
  • Rely on the Service as a substitute for professional advice from a qualified lawyer or RCIC where your situation requires it.

5. IRCC data and processing times

Processing times, draw data, and related metrics are derived from official or publicly available IRCC sources and may be delayed, incomplete, or change without notice. We do not guarantee accuracy, completeness, or that your application will be processed within any displayed timeframe. Always confirm requirements and times on the official Government of Canada website before applying.

6. AI and document review features

Letter, SOP, and similar review tools produce automated suggestions based on general criteria. Outputs may contain errors or omissions. You must review and verify all content before submission to IRCC or any third party. We are not liable for refusal, delay, or adverse outcomes resulting from use of automated feedback.

7. Expert messaging

Where available, "Ask an expert" or consultant features provide general guidance only, not legal representation. Response times are targets, not guarantees. Communications may be stored to deliver the Service and for quality assurance, as described in our Privacy Policy.

8. Intellectual property

The Service, including text, graphics, logos, software, and design, is owned by VisaFlow or its licensors and protected by applicable intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the Service for personal immigration preparation purposes.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VISAFLOW AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR IMMIGRATION OUTCOMES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) CAD $100.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify and hold harmless VisaFlow from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your immigration applications, or your violation of these Terms.

12. Changes to the Service and Terms

We may modify the Service or these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Your continued use after changes constitutes acceptance. If you do not agree, stop using the Service and close your account.

13. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. Courts in Ontario shall have exclusive jurisdiction, subject to mandatory consumer protections in your province of residence where applicable.
